Acceptance of Terms

Welcome to Hidayah. These Terms of Use ("Terms") govern your access to and use of the Hidayah mobile application ("App") and any related services provided by us.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

App License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, or sell access to the App
• Remove or alter any proprietary notices or labels on the App
• Use the App for any commercial purpose without our written consent
• Create derivative works based on the App

Subscriptions & In-App Purchases

The App offers optional premium subscription plans that unlock additional features. All purchases are processed through Apple's App Store.

Subscription Plans

• Monthly subscription – billed monthly
• Annual subscription – billed once per year (best value)

Billing & Renewal

• Payment is charged to your Apple ID at the time of purchase confirmation.
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• The renewal price is the same as the original subscription price unless stated otherwise.

Cancellation

• You may cancel your subscription at any time through your Apple ID Account Settings (Settings → [Your Name] → Subscriptions).
• Cancellation takes effect at the end of the current billing period. You retain access to premium features until then.
• Deleting the App does not cancel your subscription.

Refunds

• All purchases are final and non-refundable except as required by applicable law.
• Refund requests must be submitted directly to Apple through Apple's standard refund process.

Restoring Purchases

• You may restore previous purchases using the "Restore Purchases" option in the App's Paywall screen.

Acceptable Use

You agree to use the App only for lawful purposes and in a manner consistent with its intended use as an Islamic companion application. You agree not to:

• Use the App in any way that violates applicable local, national, or international laws or regulations
• Post, transmit, or share content that is hateful, discriminatory, or harassing
• Attempt to gain unauthorized access to any part of the App or its related systems
• Use automated tools, bots, or scripts to access or interact with the App
• Interfere with or disrupt the integrity or performance of the App
• Attempt to probe, scan, or test the vulnerability of the App
• Use the App in any way that could damage our reputation or that of the Islamic community

AI Islamic Guide

The App includes an AI-powered Islamic Guide feature that provides responses to Islamic questions. By using this feature, you acknowledge and agree that:

• AI responses are generated automatically and are provided for informational and educational purposes only.
• The AI Guide is not a certified Islamic scholar, mufti, or religious authority. Responses should not be treated as official fatwas or religious rulings.
• For important religious decisions, please consult a qualified Islamic scholar.
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content for your specific situation.
• Your chat messages are processed by Google's Gemini AI. Do not share sensitive personal information in the chat.
• We reserve the right to set limits on the number of free messages per day.

Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• Prayer times will be 100% accurate for all locations and calculation methods
• The App will be uninterrupted, error-free, or free of viruses
• AI-generated Islamic guidance content is accurate, complete, or suitable for your situation
• The App will meet your specific requirements

Prayer time calculations are estimates based on astronomical data and selected calculation methods. Always verify prayer times with your local mosque for official times.

Intellectual Property

The App and all of its content, features, and functionality (including but not limited to all text, graphics, logos, icons, design, and code) are owned by us and are protected by copyright, trademark, and other intellectual property laws.

Quranic text and translations used in the App are from open-source and publicly licensed sources. All other content is proprietary.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit in any way any of our proprietary content without our prior written consent.

Third-Party Services

The App integrates third-party services including Firebase (Google), RevenueCat, Apple services, and prayer time API providers. Your use of these services is subject to their respective terms and privacy policies.

We are not responsible for the practices or content of third-party services. Links to third-party websites or services in the App are provided for convenience only.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT FULLY APPLY TO YOU.

Termination

We may suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the App ceases immediately. You may terminate your use of the App at any time by deleting it from your device.

Provisions of these Terms that by their nature should survive termination shall survive (including intellectual property, disclaimer, and limitation of liability sections).

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or a court of competent jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date at the top of this page.

Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, please stop using the App.
